Terms & Conditions of Booking
Our commitment to you: Your contract is with Mr. John Poyner trading as “Highland Nature” (hereinafter also referred to as “I”, "we" or "us"), of 6, Mackenzie Crescent, Nethybridge, Inverness-shire, United Kingdom. All breaks you book with us are organised and sold subject to the following conditions:
Booking and Payment
1) To confirm your booking you are required to pay a non-refundable deposit of £100 (£50 Mid-Week Breaks). Your balance must be paid by the due date shown on your invoice or in correspondence (normally 56 days prior to the holiday start date) and failure to do so may result in the cancellation of your booking. Once we receive your deposit and having accepted your booking, the contract between us will become binding and we will send you an invoice for the balance and advise you of the date for payment of the same. Prices are quoted in UK Sterling. Payment can be made by Cheque or Bank Transfer (details on request).
Cancellation of Booking
2) Any cancellation must be notified in writing by the person who made the booking. If you cancel your holiday:
a) more than 56 days prior to the start of your holiday, you will only be charged your deposit.
b) between 56 and 28 days, you will be charged 25% of the holiday cost.
c) less than 28 days before the start of your holiday or on or after the commencement of the holiday, you must pay the full holiday price.
We strongly advise you to take out insurance against cancellation charges, you will be advised of these by us on receiving your notice of cancellation.
Changes or Cancellation by Us
3) Before you enter into a contract with us, we reserve the right to change any of the facilities, services or prices advertised. We also reserve the right to cancel the holiday. For example, if the minimum number of clients required for a trip is not met, we may have to cancel your holiday. It is unlikely we will have to make any changes or cancel your holiday, changes are usually very minor, and we will advise you at the earliest possible date if this happens. If a major change becomes necessary, we will inform you as soon as reasonably possible if there is time before your holiday begins. A major change is an alteration of the start or finish time of your holiday by more than 12 hours. When a major change occurs you will have the choice of cancelling your holiday and we will refund all payments made directly to us in respect of the holiday cost. We will not however be in a position to refund any personal expenses you may have incurred as a result of your booking. Where a major change or cancellation arises from circumstances amounting to force majeure (see below), we will endeavour to refund all sums as yet unpaid by us to our suppliers, however it is your responsibility to claim the remainder of any irrecoverable payments and charges from your travel insurers.
Information Provided by Us
4) Any information provided by Highland Nature on such matters as climate, suitable clothing, biting insects, etc. is given in good faith but without responsibility on our part.
Client Responsibility
5) It is a condition of booking that you agree to behave in a manner suited to a group environment and not act in any way which may offend, endanger or upset other members of the party. You must also not behave in any way which may affect the running of the holiday or the enjoyment of the other members of the group. We reserve the right to dismiss any person from the tours for behaviour which is deemed as such. In such instance no refund will be offered. Smoking is accepted but we please ask if this is done away from other members of the party at all times.
Accommodation
6) Accommodation is as stated in the Holiday Booking. Any changes to this will be notified as soon as possible.
Personal Travel Insurance
7) It is a condition of booking that you take out Personal Travel Insurance.
It is your responsibility to ensure that the insurance cover you purchase is adequate and although we do not normally ask you to provide us with this beforehand, a copy must be provided if requested by us at any time.
All luggage and personal equipment are, at all times, at your own risk. We will not be responsible whatsoever for any loss, damage to your luggage and/or personal equipment. We therefore recommend that your insurance policy includes cover for baggage and personal items.
Medical and Dietary Conditions
8) If you are affected by a medical condition which may affect your enjoyment of the holiday, you must advise this at the time of booking. Similarly you must advise us of dietary conditions/allergies and preferences at the time of booking.
Our Liability & Compensation
9) Highland Nature will accept liability for negligence causing direct physical injury to persons only to the extent that it is obliged under Scottish law. We cannot be held responsible for any mishap to yourself or your property, and in particular for the consequences of public transport cancellations, vehicle accidents, strikes, sickness, authority intervention or other such happenings amounting to force majeure. Highland Nature is covered by public liability insurance up to a maximum of £2,000,000 in any one event. By booking with us you acknowledge that we have taken all reasonable steps to safeguard its liability in this respect.
We shall not be liable for any damages caused by the total or partial failure to carry out the holiday if such failure is: attributable to anyone other than Highland Nature; unforeseeable or unavoidable and attributed to a third party unconnected to us; a result of unusual or unforeseeable circumstances, reasonably beyond the control of Highland Nature; a result of an event which Highland Nature or any of its agents, even with all due care, could not foresee. Where the damage relates to damage caused by the provision of road, rail, river or sea transport, or hotel accommodation, any compensation payable will be limited by the Athens Convention 1974 (sea), the Berne Convention 1961 (rail), and the Paris Convention 1962 (hotel accommodation). All air transport is undertaken entirely at your own risk. Any independent travel (or other arrangements) you make before, during and after the holiday are entirely at your own risk.
Complaints Procedure
10) If you have a complaint about the holiday you should make it known to Highland Nature at the earliest opportunity. If you feel your complaint has not been properly dealt with we shall endeavour to agree a settlement with you. Any outstanding complaint not resolved during the trip should be notified to us in writing within 30 days of the scheduled date of the end of your holiday.
Variation of Booking Conditions
11) The booking conditions may only be varied by Highland Nature in writing. On booking you agree to accept all these conditions, and when we accept your booking we agree to carry out our obligations to you as defined in holiday information provided to you. Both sides of this agreement are made subject to, and must be interpreted and enforced according to Scottish Law in a Scottish Court.
